Indian polity Group Discussion

1. PLURAL EXECUTIVE

A plural executive is formed when there are several officials that fill the executive administrative function. Most states share executive authority among several officials all of whom are elected by the states population. There officials include a governor, lieutenan governor, attorney general, Treasurer, Auditor and Secretary of State.

2. SECULARISM

A concept related to the separation of state and religion. Secularity is the state of being free from religious or spiritual qualities, for instance eating a neck, playing a hand, or bathing are examples of secular activities, because there is nothing inherently religious about them. Saying a prayer or visiting a place of worship are examples of non-secular activities. Am approximate synonym for secular is worldly in the sense "this worldly" although from a christian point of they "secular" may be used as contrast to spiritual. The root word of secular is SAECULUM, which in fact refers to the passage of time rather than a physical place or thing. Thus that which is secular can be more accurately thought of as taking place within time, rather than in relation to eternity.

Secularism has two distinct meanings

1. It asserts the freedom of religion and freedom from religion, within a slave that is neutral on matters of belief and gives no state privileges or subsidies to religion.

2. It refers to a belief that human activities and decisions should be based on evidence and fact, and not superstitous beliefs, however devoutly held, and that policy should be free from religious denimbuion. For example a society deciding whether to promote condom use might consider the issues of disease prevention, family planning and women's rights. A seculasist would argue that such issues are relevant to public policy making, whereas bibilical interpretation or church doctrine should not be considered and are irrelevant.

3. DOES THE POWER OF PARLIAMENT TO FINISH THE AREA OF A STATE INCLUDE ALSO THE POWER TO CEDE INDIAN TERRITORY A FOREIGN COUNTRY?

In the case of In Re BERUBARI held that the parliament has the power cede any part of the territory of india in favour of a foreign state. It has to be amended as per Art368 of of the constitution. Its implementation would naturally involve the alteration of the content of and the amendment of Art1 and of the 1st schedule.

4. According to the constitution Art 324 Election Commissioner can be removed only on the recommendation of the chief election commissioner. The chief election commissioner should not be treated as equal with the other member election commissioners. It was decided in the NAVEEN CHAWLA case.

The chief Election Commissioner cannot exercise the power of suo moto recommendation.

My Experience

We know our Indian constitution aspired its provisions from many countries. It is lengthhest constitution. Earlier it contains Articles 395. At Present it has Articles 442. Ok let me come to the point.
How could we remember these Articles. Simple First you by heart the Index. Then mark each and every sub clauses make a note. Try to remember the Headings. Remembering is possible only by repeated studying and revisions.
2. You can use acronyms. For example EFLEMR. Each letters says about fundamental rights guaranteed in our constitution.
3. Imagine any creature to remember. For example I used to think about a film in which actor VIJAY rang cycle bell to pigeon whenever I think about ornithology and whenever I saw fan I think about wheel image. Because the fan was invented by wheeler.
4. I used to play with friends I used something my friend will tell legal provision regarding that if he is wrong I'll correct his mistake.
These are the very few methods which I use for remembering legal provisions. Whatever it may be its all depends on our mentality. Frequent revisions and reading. Getting clarifications discussions will help more.
